LAND ARRANGEMENTS

 

Wisdom Passages LLC reserves the right to change the itinerary due to unforeseen circumstances. In all cases, Wisdom Passages LLC will do its best to maintain the content of the tour. If the tour services as indicated by the itinerary cannot be supplied or there are changes in the itinerary for reasons beyond the control of Wisdom Passages LLC we will arrange for the provision of comparable services. Wisdom Passages LLC reserves the right to make changes in the itinerary whenever Wisdom Passages LLC deems it necessary to the comfort, convenience, and safety of the participant at any time. No refund will be paid for unused services such as transfers, sightseeing, meals, hotel accommodation, entrance fees, and others that are listed in the tour program.

 

ASSUMPTION OF RISK, WAIVER, & RELEASE OF LIABILITY

 

I, the undersigned, acknowledge and recognize the risks, dangers, and hazards inherent in my participation in any Wisdom Passages, LLC Israel Tour (the “Tour”), including but not limited to any and all related travel risks, illnesses, personal injury, death, property damage, acts of terrorism, or other loss or destruction of life or property, as well as the unknown dangers and hazards which may arise in the course of my participation in the Tour.  I voluntarily elect to participate and assume full responsibility for any and all risks of damage or loss to property owned by me, or personal injury, including death, that I may sustain during the Tour, including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons and/or entities being released herein.

 

Further, in consideration for my participation in the Tour, I hereby take action for myself, my spouse, members of my family, my executors, administrators, personal representatives, heirs, next of kin, successors, and assigns as follows:

 

(A)     I WAIVE, RELEASE, FOREVER DISCHARGE, AND PROMISE NOT TO SUE Wisdom Passages, LLC., and/or its members, managers, directors, officers, employees, volunteers, representatives, and agents (collectively “Released Parties”) from and against any and all claims, liabilities, causes of actions, or demands, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, sickness, illness, harm, loss, property damage, property theft, or actions of any kind which may occur to me during my participation in the Tour, including my travel to, from, and during the Tour;

 

(B)     I INDEMNIFY AND HOLD HARMLESS the Released Parties from any and all loss, damage, costs (including court costs and attorney fees), liabilities, claims, causes of actions or demands arising out of or made as a result of my participation in the Tour, whether caused by the negligence or carelessness on the part of the Released Parties.

 

I acknowledge that the Released Parties: (1) are not responsible for the errors, omissions, acts, or failures to act of any person or entity conducting a specific activity on my behalf as the Tour participant or on behalf of the Released Parties; (2) assume no responsibility or liability in connection with the services of any train, vehicle, airplane, or other conveyance used either wholly or in part; (3) are not responsible for any error, omission, act, injury, loss of property, accident, or delay resulting from any defect in or operation of any conveyance through neglect or default of any company or persons engaged in the conveying of passengers or their luggage; (4) accept no responsibility for losses or additional expenses due to delays or changes in train, vehicle, airplane, or other conveyances, (5) accept no responsibility for losses or additional expenses due to sickness, accident, weather, strikes, war, violence, quarantine, or other causes, as all such losses or expenses must be borne by me.

 

I certify that there are no health-related reasons which should preclude my participation in the Tour and that no medical professional has advised me not to participate in the Tour.

 

I hereby authorize and appoint Wisdom Passages, LLC to take all actions, including medical procedures, necessary on my behalf that may arise during an emergency or exigent circumstances in the event of injury, harm, accident, and/or illness during my participation in the Tour.

 

This Assumption of Risk, Waiver, & Release of Liability shall be construed broadly to provide a waiver and release to the maximum extent permissible in accordance with the laws of the State of Illinois, including its choice of laws provisions.

 

If it is determined that any of the provisions of this contract is invalid or unenforceable, the remaining provisions of this contract will not be affected and will be given full force, effect, and validity without regard to the invalid portion(s).
